Criminal law does not recognize only archetypal crimes, that is, acts which at different stages of societal development have been considered unacceptable for almost all civilizations. For example, theft, murder, etc. With the development of bureaucracy, new types of crimes have emerged and, accordingly, the necessity of their criminal punishment has become an issue on the agenda.<\/p>\n

Such crimes include the use of forged documents. A person usually resorts to the use of a falsified document in order to fulfill personal objectives, for example, forging a higher education diploma, a driving license, etc. The above examples may be perceived by society as completely harmless acts; however, it is a punishable offense and may result in deprivation of liberty.<\/p>\n

Accordingly, we considered it necessary to present an article about the use of forged documents as a crime and to examine the constituent elements of this offense, the existence of which would subject a person to criminal liability.<\/p>\n

1. What Does the Use of a Forged Document Mean<\/h3>\n

Article 362 of the Criminal Code criminalizes not only the use of a forged document, but also its acquisition, possession, and sale. In order for a person to be held liable for this act, the following conditions must be met:<\/p>\n

\u27a2 The criminal case must involve the object of the offense, namely an official document, certificate, seal, stamp, or form.<\/p>\n

\u27a2 The official document must be falsified, i.e., counterfeit. For example, a person who does not have a driving license forges one in order to present it in the event of being stopped by the patrol police. By this act, the person has already committed the offense under discussion.<\/p>\n

\u27a2 Prior knowledge \u2014 the person using the forged document must be aware of its falsity and must intentionally use it despite this fact.<\/p>\n

2. Business at Risk<\/h3>\n

This offense may be associated not only with individuals but also with legal entities, when the offense is committed in the name of, through, or for the benefit of a company. According to Georgian criminal law, a legal entity may be held liable if the criminal act is committed by a director, representative, or other authorized person acting in the interests of the organization.<\/p>\n

Liability may also arise when the company fails to exercise proper control and supervision, which enabled the commission of the offense.<\/p>\n

The liability of a legal entity does not exclude the liability of specific individuals. In practice, this means that both the company\u2019s director or employee and the company itself may become subjects of criminal prosecution.<\/p>\n

In such cases, sanctions provided by law may be applied to a legal entity, including fines, restriction of business activity, and even liquidation.<\/p>\n

Therefore, it is particularly important for companies to implement internal control mechanisms, verify the authenticity of documents, and raise employees\u2019 legal awareness in order to avoid the legal risks provided under Article 362.<\/p>\n
