However, this right does not mean that a person may knowingly disseminate false information and accuse an innocent individual of committing a crime. Such conduct threatens both the rights of the individual concerned and the effective functioning of the justice system. Therefore, Georgian legislation considers false reporting a criminal offence and establishes strict liability for such conduct.<\/p>\n<p data-start=\"636\" data-end=\"1002\">In practice, false reporting often results from personal conflicts, family disputes, disagreements between business partners, revenge, or other interests. In some cases, an individual attempts to use criminal-law mechanisms to exert pressure on the other party or damage their reputation; however, such conduct may itself constitute grounds for criminal prosecution.<\/p>\n<p data-start=\"1004\" data-end=\"1039\"><strong data-start=\"1004\" data-end=\"1039\">What Does False Reporting Mean?<\/strong><\/p>\n<p data-start=\"1041\" data-end=\"1249\">False reporting occurs when a person knowingly provides an authorised body with information concerning a crime that does not correspond to reality, with the intention of unjustifiably accusing another person.<\/p>\n<p data-start=\"1251\" data-end=\"1594\">At the same time, it is important to distinguish false reporting from a good-faith mistake. If a person genuinely believed that a crime had occurred and approached the relevant authority based on that belief, but a subsequent investigation failed to confirm the fact, this does not automatically mean that the person committed false reporting.<\/p>\n<p data-start=\"1596\" data-end=\"1781\">Liability arises only when it is established that the reporting person knew in advance that the information was false and, nevertheless, knowingly provided it to the relevant authority.<\/p>\n<p data-start=\"1783\" data-end=\"1834\"><strong data-start=\"1783\" data-end=\"1834\">What Does the Criminal Code of Georgia Provide?<\/strong><\/p>\n<p data-start=\"1836\" data-end=\"1931\">Article 373 of the Criminal Code of Georgia establishes criminal liability for false reporting.<\/p>\n<p data-start=\"1933\" data-end=\"2049\">According to the first paragraph of the Code, false reporting concerning the commission of a crime is punishable by:<\/p>\n<ul data-start=\"2051\" data-end=\"2208\">\n<li data-section-id=\"1r23yae\" data-start=\"2051\" data-end=\"2060\">a fine;<\/li>\n<li data-section-id=\"1bm01m4\" data-start=\"2061\" data-end=\"2114\">community service for a period of 180 to 240 hours;<\/li>\n<li data-section-id=\"fo2ykp\" data-start=\"2115\" data-end=\"2168\">corrective labour for a period of one to two years;<\/li>\n<li data-section-id=\"reiug3\" data-start=\"2169\" data-end=\"2208\">or imprisonment for up to four years.<\/li>\n<\/ul>\n<p data-start=\"2210\" data-end=\"2319\">The law provides for more severe liability where false reporting is accompanied by aggravating circumstances.<\/p>\n<p data-start=\"2321\" data-end=\"2544\">If a person falsely accuses another individual of committing a serious or particularly serious crime, or artificially creates evidence supporting the accusation, they may face imprisonment for a period of two to four years.<\/p>\n<p data-start=\"2546\" data-end=\"2607\">The most severe liability arises when the aforementioned act:<\/p>\n<ul data-start=\"2609\" data-end=\"2706\">\n<li data-section-id=\"8rorqa\" data-start=\"2609\" data-end=\"2668\">is committed for material gain or other personal motives;<\/li>\n<li data-section-id=\"12dv0ss\" data-start=\"2669\" data-end=\"2706\">or results in serious consequences.<\/li>\n<\/ul>\n<p data-start=\"2708\" data-end=\"2788\">In such cases, the punishment is imprisonment for a period of four to six years.<\/p>\n<p data-start=\"2790\" data-end=\"2846\"><strong data-start=\"2790\" data-end=\"2846\">Why Does the Law Treat False Reporting So Seriously?<\/strong><\/p>\n<p data-start=\"2848\" data-end=\"3136\">False reporting is not merely an act directed against one individual. It also harms the justice system, as law enforcement authorities are compelled to devote time and resources to investigating a non-existent crime, while the detection and investigation of actual crimes may be hindered.<\/p>\n<p data-start=\"3138\" data-end=\"3552\">Furthermore, a victim of a false accusation may face serious legal and personal difficulties. An investigation may be initiated against them, their professional activities may be restricted, their business reputation may be damaged, and their dignity may be called into question in the eyes of society.
